Trying to LIE his way out of his LEGAL TROUBLES

Aware Bear Computers (a “business” in Rochester New York and owned and operated by Mr. Andre Leite Alves, often signing e-mails as Mr. Arthur Leite) has been undertaking actions that make it extremely easy to expose his lies and substantiate them with cold hard proof and evidence. Evidence that he himself provides without so much as having a clue that he did exactly that. This makes Alves not only a liar but the very clown that gets ridiculed for his actions.

When the original article that exposed Andre Leite Alves and its copyright infringement was published, one of the things that Mr. Didak did was to post a link to it on the advertisement page on RocWiki (a wiki about the Rochester, NY) where Aware Bear had been advertising. This is one of the websites where Andre Alves got in trouble and recognized as a spammer. Shortly after the link was added Andre attempted to remove it. He probably didn’t like certain experiences to be published and found by potential customers (or should we call them “victims”?). This action got Andre a warning from the wiki administrators and the page got locked so changes to it could no longer be made.

A few days later Andre Leite Alves contacted the administrators of the RocWiki (by using a publically accessible google group). Andre had hoped that his statements were to be kept private but one of the administrators (Dave Mahon) that responded to him accidentally (or maybe intentionally) replied with a public reply.

“Can you explain – specifically – why you would like to have the pages removed? If and when we do agree to remove the pages, Mr. Didak’s comments will be removed as well”.

“In the meantime, despite the negative quality of his comments, I have no way of determining the truth value of his claims and since they are not of a personal nature and I do not feel comfortable removing them. Should you convincingly demonstrate to me your claim that this is a scam, however, I will be happy to remove his comment. I should also clarify that even though Pete and I are admins, we are not authorized to unilaterally remove whole pages or comments except in the most extreme of cases; the final authority rests in the community that reads and responds to this mailing list”.

The reply shows that Andre Leite Alves wanted certain pages REMOVED, thereby making an attempt to suppress, silence, and censor the growing negative attention that he unleashed upon himself as a result of his fraudulent activities. Also indicative in the reply is that Andre claimed that the story about the theft he committed and the creation of an an unauthorized derivative work was a SCAM.

Behavior like that is typical for low level con-artists and natural born liars (a.k.a. pathological liars). In almost every situation that involves con-artists that are caught running a scam or after they have generated a really bad reputation for themselves, it is always the con-artist that claims that the details exposed about them is the scam and that they are nothing more than the poor victim of slander and libel. Taking on the victim role by con-artists is so typical that it only helps further the understanding that Andre Leite Alves and his Aware Bear “company” are extremely questionable and untrustworthy.

Jay Sweet proposed that, “As a compromise, what if the AwareBear folks were allowed to put a comment w/ link below his, offering a link to an explanation of their side of the story, and then we ask that neither of them add any further comments to the article?” but Andre Leite Alves did not agree with that because anything he would claim, in public writing, using another series of LIES, would only result it in being used against him in court of law again. Like a proven con-artist and bottom-feeder Andre Leite Alves prefers to communicate his lies in private and out of public view.

Other people in Rochester responded to the situation as well, in particular “BadFishROC” who wrote “I think he (Stefan) posted that there to let people know that Aware Bear stole an image from his web site for they marketing. I have seen the flier (and may still have one at work) and they definitely stole the image.” And this person is entirely correct since the printed brochures were in possession of Mr. Didak shortly after Aware Bear started handing them out. Many others have since offered to send copies of the brochures for safe keeping and evidence gathering.

Andre Leite Alves has been lying even more as was discovered when Dave Mahon wrote “We (the AdminGroup) are well aware of the involvement of lawyers on both sides.” The real fact and truth here is that there has not been ANY involvement of lawyers on the side of Andre Leite Alves and Aware Bear Computers.

Every action taken by Andre Leite Alves shows that he has not even consulted one and most certainly did not receive any assistance of one as his next actions demonstrated. Andre told people that he was the one taking legal action against Mr. Didak and his website. This, of course, to the amusement of Mr. Didak who would look forward to that. A few days later it was clear what Andre Leite Alves meant with “his lawyers” and “him taking legal action”. Prepare yourselves to start laughing your behind off because this can’t get any funnier!

The so-called “legal response” that involved the imaginary lawyers of Andre Leite Alves was a DMCA take down notice that he sent to the domain registrar of stefandidak.com. Not only does this show that Andre Alves is clueless about the internet but that the DMCA notice itself, riddled with unfinished sentences, spelling errors, and a more lies, is one where Andre Leite Alves admitted that he had stolen material and used it to create derivative works without permissions.

Poor delusional Andre Alves explicitly claims, in writing, that the images of Mr. Didak’s famous Home Office were actually HIS property, and signed it to be true under PENALTY OF PERJURY. The conclusion; Andre Leite Alves admitted to his fraudulent misrepresentation, admitted to the copyright infringement, and perjured himself at the same time. If that doesn’t make him a total unadulterated fool we don’t know what would! 🙂

The reaction from the law firm hired by Mr. Didak was with his admission of guilt there’s no lawyer in town that would even touch his case with a ten foot pole”.

The way this amateurish DMCA notice was constructed displays that Andre Leite Alves did not have any form of legal help because any semi-competent lawyer or legal aid would never, NEVER in a million years, allow a client to put all that in writing. His DMCA actions had, of course, absolutely no effect (much like other services rendered by Aware Bear from what we’ve been hearing from customers that have contacted us) but it seems that Andre just wanted to “try it” and had high hopes that it would get the material removed from the internet. It shows the type of person he is, the kind of “business” he is running, or pretends to be running, and the character of Mr. Alves. Meanwhile, Mr. Didak’s attorneys did, indeed, break out in physical laughter after receiving a copy of the DMCA notice.

A dissection of his DMCA take down notice can be found on this page and the original one by Mr. Didak.

Where is the legal action that Andre Leite Alves lied about to the RocWiki community? It still needs to materialize. Then again, if you consider that Alves does everything “on the cheap” (from his webhosting to his brochures and marketing material that is riddled with stolen material) it probably indicates that Andre doesn’t have the funds to even consult a real lawyer. Maybe this also means he’s not just a con-artist and liar but a bad one, a failed liar and incompetent con-artist. When asked, Mr. Didak’s reaction was, verbatim:

“I can’t wait! The idea of Mr. Alves trying to take me to court is beyond funny. Just think how that case would unfold and collapse in on him. Just think about all the fun this could present to many, many of my readers. It’d be worth every penny I’d have to spend on it”.

In conclusion: In the mind of Andre Leite Alves the concept of “taking legal action” really means “making a total fool of myself, ensure myself a reputation of town clown, incriminate myself to the point where no lawyer would even touch my case, admit in writing and under penalty of perjury that I’m a thief, and at the same time show myself as being delusional enough that I feel entitled to take anyone’s material at any time and claim it is my own while attempting to get the original material removed using overtly amateurish DMCA take-down notices”.
